Please read these Terms and Conditions ("Terms") carefully before using the La Bestia en el Arte website and raffle platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By using this website and/or entering the raffle, you confirm that you are at least 18 years of age, a legal U.S. resident in an eligible jurisdiction, and have read, understood, and agree to these Terms, the Official Rules, and the Privacy Policy.
2. Raffle Entry
Entry into the raffle constitutes agreement to the Official Rules, which are incorporated herein by reference. No purchase is necessary to enter. Paid entries do not guarantee winning. All eligibility requirements in the Official Rules apply.
3. Payments
All payments are processed securely through Stripe, Inc. La Bestia en el Arte does not store your credit card or payment information. By submitting a payment, you authorize the charge for the selected number of raffle tickets at $10.00 USD each.
Refund Policy: All ticket sales are final and non-refundable except: (a) if the raffle is cancelled by the Sponsor before the drawing date, in which case full refunds will be issued to all paid entrants within 14 business days; or (b) as required by applicable law. Chargebacks initiated outside of these conditions may result in entry disqualification.
4. User Conduct
You agree not to:
- Submit false or misleading information
- Attempt to enter more than the maximum allowed tickets per person
- Use automated means to submit entries
- Interfere with the operation of the Service
- Use the Service for any unlawful purpose
5. Intellectual Property
All content on this website, including text, graphics, logos, images, and video, is the property of La Bestia en el Arte or its content suppliers and is protected by U.S. and international copyright laws. You may not reproduce, distribute, or create derivative works without written permission.
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LA BESTIA EN EL ARTE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. You use the Service at your own risk.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LA BESTIA EN EL ARTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU IN CONNECTION WITH THE RAFFLE ENTRY GIVING RISE TO THE CLAIM.
8. Indemnification
You agree to indemnify, defend, and hold harmless La Bestia en el Arte and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
